When a couple jointly buys a piece of property, it is pertinent for them to properly state their names on the title documents.

If, for example, the husband is Mr. Hammed Uche ADEBOWALE, and the wife is Mrs. Ada Chinyere ADEBOWALE, it is not right for them to state their names as: Mr. & Mrs. ADEBOWALE or Mr. & Mrs. Hammed Uche ADEBOWALE.

You know why? Any woman can fit in as Mrs. ADEBOWALE. Hence, with that pattern of writing name, the wife’s stake in the ownership of the property is not guaranteed.

The proper and acceptable manner to write the names of the couple on any property document is Mr. Hammed Uche ADEBOWALE, and Mrs. Ada Chinyere ADEBOWALE. With this, the wife’s stake in the ownership of the property is secured.

Now, if the names of couples are wrongly written on a property document, all that needs to be done is for them to obtain a Deed of Rectification form at the Ministry of Land and Housing to correct the mistake. A Deed of Rectification is the legal instrument that is used to correct errors in the name(s) of the parties on a property transfer document.

Please, ensure that your names, as a couple, are properly written on your property documents.
